The two departments issued an announcement on the redistribution of tariff quotas for agricultural imports in 2022
According to the Interim Measures for the Administration of Import Tariff Quotas of Agricultural Products (Decree No. 4 of 2003 of the Ministry of Commerce and the National Development and Reform Commission), Hereinafter referred to as the “interim measures”), the grain import tariff quota of 2022 applications and distribution rules for the cotton import tariff quota of 2022 applications and distribution rules “(the National Development and Reform Commission (announcement no. 7, 2021) and the sugar import tariff quota of 2022 applications and distribution rules for (the Ministry of Commerce announcement no. 30, 2021) the relevant rules In 2022, we will announce the redistribution of import tariff quotas for agricultural products as follows.
I. End users holding import tariff quotas for wheat, corn, rice, cotton and sugar in 2022, who have not signed import contracts for the full quota in that year, or have signed import contracts but are not expected to ship from the port of origin before the end of the year, Shall return the uncompleted or uncompleted part of the amount of tariff quota held by them to the Development and Reform Commission and the competent commercial department of the place where they are located (province, autonomous region, municipality directly under the Central government, city independently listed in the plan, Xinjiang Production and Construction Corps) before September 15. The National Development and Reform Commission and the Ministry of Commerce will redistribute the returned quotas. For the end users who do not return the quota before September 15 and do not fully use the quota before the end of the year, the National Development and Reform Commission and the Ministry of Commerce will make a proportional deduction for the corresponding varieties when allocating the import tariff quota of agricultural products for the next year.
II. End users who have obtained the 2022 import tariff quota of commodities listed in Article 1 of this Announcement and have fully used it (copy of import customs declaration is required), and new users who meet the application conditions listed in the relevant allocation rules but have not obtained the 2022 import tariff quota at the beginning of the allocation, may apply for the redistribution of import tariff quota of agricultural products.
III. The application enterprise shall submit the redistribution application materials to the Development and Reform Commission of the local (province, autonomous region, municipality directly under the central government, city with separate planning, Xinjiang Production and Construction Corps) and the competent commercial department from September 1 to 15. Please refer to Appendix 1, 2 and 3 for the application form of relevant commodities.
IV. Provinces, autonomous regions, municipalities directly under the Central Government, cities with separate plans, Development and Reform Commission of Xinjiang Production and Construction Corps, and competent commercial departments will begin to receive the completed application materials for grain and sugar redistribution as required on September 1, and upload the information contained in the application form to the tariff quota management system for online declaration. Before September 17, the combined application materials for redistribution shall be forwarded to the National Development and Reform Commission or the Ministry of Commerce in written form respectively. The application materials for cotton redistribution will be filled in and submitted online by the applicant enterprises through the “single window” cotton import quota management system for international trade from September 1 to 15.
V. The National Development and Reform Commission and the Ministry of Commerce shall redistribute the quota returned by users on a first-come, first-received basis. End users will be notified of the result of the tariff quota reallocation by October 1.
VI. Other matters such as the validity period of the redistributed tariff quotas shall be subject to the Interim Measures and the relevant distribution rules.
VII. The redistribution of import tariff quotas of wheat, corn, rice and cotton shall be organized and implemented by the National Development and Reform Commission in conjunction with the Ministry of Commerce, the Development and Reform Commission of all provinces, autonomous regions, municipalities directly under the Central Government, cities with separate plans, and the Xinjiang Production and Construction Corps; The redistribution of import tariff quota of sugar shall be organized and implemented by the Ministry of Commerce, the competent commercial departments of all provinces, autonomous regions, municipalities directly under the Central Government, cities with separate planning and Xinjiang Production and Construction Corps.
