To continue anti-dumping on imports of carbon steel fasteners from the EU and the UK for a period of five years
On June 28, 2010, the Ministry of Commerce (MOFCOM) issued Notice No. 40/2010, deciding to impose anti-dumping duties ranging from 6.1% to 26.0% on imports of carbon steel fasteners from the European Union. On September 9, 2011, the Ministry of Commerce issued announcement No. 56, 2011, deciding that Camax Co., Ltd. will inherit the 6.1% anti-dumping rate and other rights and obligations applicable to camax Factory Rudolf Kellerman Co., Ltd. in the anti-dumping measures on carbon steel fasteners. On June 28, 2016, the Ministry of Commerce issued the Notice No. 24, 2016, deciding to continue to impose anti-dumping duty on imported carbon steel fasteners from the European Union starting from June 29, 2016 for a period of 5 years. On September 19, 2017, the Ministry of Commerce issued Announcement No. 50 of 2017, From royal Dutch Ned history of rove holdings co., LTD., and Ned rove al Turner co., LTD., in the history of rove Barcelona co., LTD., in the history of rove mond haier co., LTD., the root in the history of rove Pekin co., LTD., in the history of rove flor lawton co., LTD., the anti-dumping tax rate applicable to the import of carbon steel fasteners changed from 26.0% to 5.5%.
On January 29, 2021, the Ministry of Commerce issued Announcement No. 3 of 2021. According to the notice, after the brexit transition period ends on December 31, 2020, the trade remedy measures previously imposed on the EU will continue to apply to the EU and the UK for the same period of time. New trade remedy investigations and reviews launched against the EU after that date will no longer treat the UK as a member of the EU.
On June 28, 2021, at the request of China’s carbon steel fasteners industry, the Ministry of Commerce (MOFCOM) issued announcement No. 14, 2021, deciding to conduct the final review of anti-dumping measures applicable to imports of carbon steel fasteners from the European Union and the United Kingdom starting from June 29, 2021.
Mofcom has investigated the possibility that dumping of carbon steel fasteners imported from the European Union and the United Kingdom will continue or re-occur if the anti-dumping measures are terminated, as well as the possibility that injury to China’s carbon steel fastener industry will continue or re-occur. And made a review ruling in accordance with Article 48 of the Anti-dumping Regulations of the People’s Republic of China (hereinafter referred to as the Anti-dumping Regulations) (see annex). The relevant matters are hereby announced as follows:
I. Reexamination ruling
The Ministry of Commerce ruled that if the anti-dumping measures are terminated, dumping of carbon steel fasteners imported from the European Union and the United Kingdom to China may continue or re-occur, and damage to China’s carbon steel fastener industry may continue or re-occur.
II. Anti-dumping measures
In accordance with Article 50 of the Anti-dumping Regulations, MOFCOM puts forward a proposal to the Customs Tariff Commission of The State Council on the basis of the investigation results. The Customs Tariff Commission of The State Council makes a decision on the basis of the recommendation of MOFCOM. Anti-dumping duties on imports of carbon steel fasteners from the EU and the UK will continue for a period of five years.
The anti-dumping duty shall be levied on the products to which the original anti-dumping measures are applied, which is consistent with the product scope specified in the Announcement No.40, 2010 of the Ministry of Commerce. Details are as follows:
Carbon Steel Fasteners (Certain Iron or Steel Fasteners), including wood screws, tapping screws, screws and bolts (with or without nuts or washers but excluding those used to fasten rails and those whose rod diameter is not more than 6mm) and washers. Nuts and fasteners used for maintenance and repair of civil aircraft are not included in the product range under investigation.
The product falls under the Import and Export Tariff of the People’s Republic of China (2022).73181200、73181400、73181510、73181590、73182100、73182200、90211000、90212900[1]。
The rate of anti-dumping duty levied is consistent with the provisions of the Announcement No. 40 of 2010, The Announcement No. 24 of 2016, the Announcement No. 50 of 2017 and the Announcement No. 3 of 2021 of the Ministry of Commerce.

III. Methods for levying anti-dumping duties
Starting from 29 June 2022, importers should pay corresponding anti-dumping duties to the Customs of the People’s Republic of China when importing carbon steel fasteners from the EU and the UK. The anti-dumping duty shall be levied on an AD valorem basis based on the customs customs value approved by the customs. The calculation formula is as follows: the anti-dumping duty = customs customs value × the anti-dumping duty rate. VAT on import links shall be levied on an AD valorem basis based on the customs customs value plus customs duties and anti-dumping duties.
IV. Administrative review and administrative litigation
In accordance with The provisions of Article 53 of the Anti-dumping Regulations of the People’s Republic of China, those who refuse to accept the decision of this review may apply for administrative reconsideration or bring a lawsuit to a people’s court in accordance with the law.
V. This announcement shall take effect as of June 29, 2022
The scope of products subject to anti-dumping duty is the same as that specified in the Announcement No. 40, 2010 of the Ministry of Commerce.
